Intake Division

The Intake Division was created in 2003 to effectively handle the increasing number of misdemeanor and felony offenses filed with the District Attorney’s Office. The Intake Division is responsible for reviewing all misdemeanor and felony cases submitted to the District Attorney’s Office from local law enforcement agencies. The review of felony cases is achieved by working in conjunction with the Grand Jury Division. The Intake Division reviews approximately 600 to 1,000 cases each month.

When a case is submitted to the District Attorney’s Office, usually by a local law enforcement agency, it is entered into the office computer system for tracking purposes by the secretaries assigned to the Division, and is then given to an experienced felony prosecutor for review. Cases are scrutinized by the prosecutors to determine if the facts necessary to prove an offense are present. For a misdemeanor offense, a charging instrument called an Information is prepared and filed with the County Clerk’s Office if facts which support all of the requisite legal elements of an offense are present in a case filed with the Intake Division. For a felony offense, the case is sent to the Grand Jury Division to schedule the case for consideration by the Collin County Grand Jury if all of the requisite legal elements of an offense are present

A case that does not meet the legal requirements for filing and acceptance by the Intake Division may be returned to the filing agency for additional information and investigation, or the case may be declined for prosecution.

The Intake Division is responsible for handling examining trials held in the Justice of the Peace Courts, as well as staffing the felony auxiliary court. Intake attorneys are also available to local law enforcement agencies for general questions and assistance in pending investigations.

This Division is composed of three attorneys, three secretaries, and the combined resources of the District Attorney Investigative Division and the Grand Jury Division.
